By accessing or using this directory, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service. These Terms apply to all users, including visitors, practitioners with listed profiles, and clients making bookings.

Services

Mental Health Professionals Australia is an online directory that connects people seeking mental health support with qualified practitioners. We provide a platform for practitioners to list their profiles and for clients to search for, view, and request appointments with practitioners. We are a technology intermediary only — we do not provide mental health services ourselves and are not a party to the therapeutic relationship between a client and a practitioner.

Practitioner responsibilities

If you list your practice on Mental Health Professionals Australia, you warrant that:

• All information in your profile — including qualifications, registration numbers, specialisations, and fees — is accurate and kept up to date
• You hold all required registrations, licences, and insurances to practise in the relevant jurisdiction
• You will respond to booking requests in a timely manner and notify clients promptly if you are unable to accommodate a request
• You will comply with all applicable professional standards, including those set by AHPRA and relevant professional bodies, when delivering services to clients found through the directory

We reserve the right to remove or suspend any profile that we reasonably believe contains inaccurate information or that is associated with unprofessional conduct.

Accounts

Practitioner accounts require registration. You are responsible for maintaining the confidentiality of your account credentials and for all activity carried out under your account. Notify us immediately if you suspect unauthorised access. Accounts may not be shared or transferred without our written consent.

Acceptable use

You agree not to:

• Use the directory for any unlawful purpose or in breach of applicable law
• Submit false, misleading, or fraudulent information
• Attempt to gain unauthorised access to any account or system
• Use automated means to scrape, copy, or download directory content without our written consent
• Use the directory in a way that interferes with its operation or degrades service quality for other users
• Harass, impersonate, or misrepresent your identity to other users

Intellectual property

The Mental Health Professionals Australia platform, including its design, software, and directory structure, is owned by or licensed to AI Enabled. You retain ownership of content you submit (e.g. your practitioner profile). By submitting content, you grant us a non-exclusive, royalty-free licence to display and reproduce it for the purpose of operating the directory.

Limitation of liability

Mental Health Professionals Australia facilitates connections between clients and practitioners but does not endorse, guarantee, or verify the quality of any practitioner's services. We are not responsible for the professional conduct of practitioners listed on the directory or for the outcome of any therapeutic relationship.

To the maximum extent permitted by Australian law, AI Enabled is not liable for any indirect, incidental, special, or consequential loss arising from your use of the directory. Our total liability for any claim under these Terms is limited to AUD $100 or the amount you paid us in the 12 months preceding the claim, whichever is greater. Nothing in these Terms limits liability that cannot be excluded under the Australian Consumer Law.

Governing law

These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales for any dispute arising under these Terms.

Changes to these Terms

We may update these Terms from time to time. We will notify registered practitioners of material changes by email at least 14 days before they take effect. Continued use of the directory after that date constitutes acceptance of the updated Terms.
